  1. 1. Inside City Limits, a Fence Needs a Permit

    The City of Murfreesboro requires a building permit to build, alter, enlarge, move or demolish a fence, whether you do the work yourself or hire someone. Normal maintenance, such as replacing fence sections, doesn't need one. Permits are issued by the Building and Codes Department at City Hall, 111 W. Vine St., 2nd floor; the fee is based on the value of the work, and the application asks for a site sketch showing property lines and the location and width of any easements. The City doesn't set a property-line setback for fences, but a fence can't encroach on a neighbor's lot, sit in a drainage or utility easement, or enter the public right-of-way unless the City Engineer approves it in writing, and the City asks that fences stay 3 feet from mechanical equipment and never enclose electric or gas meters.

  2. 2. In Unincorporated Rutherford County, File the Fence Affidavit

    Outside city limits, Rutherford County doesn't issue fence permits, but it does require a notarized Fence Design Guideline Affidavit, filed with the Planning and Engineering Department before installation starts. The County's rules cap residential fences at 8 feet in side and rear yards, require transparent construction (split rail, picket, chain link and similar) inside the required front setback, require posts set at least 2 feet into the ground, and require that posts and rails not face the street. Fences can't go in utility easements without written approval from the utility or in drainage easements without the County Engineer's consent.   3. 3. Read Your HOA Covenants First

    Many Murfreesboro neighborhoods have subdivision covenants that set fence height, material, color, style and setback, and some require an architectural review before you build. Both the City and the County say these private covenants are outside their review, so a permit doesn't mean your HOA has signed off. Send us your covenants or the HOA's fence guidelines and we'll design to them.

  4. 4. Pool Fences Are Inspected Separately

    Inside the city, the fence permit has to be issued at or before the pool permit, and a barrier is required around any pool that isn't 48 inches above the surrounding surface on all sides. In the County, the fence affidavit can't be used for a pool barrier; the barrier has to be inspected. The County's barrier handout spells out details that catch people out: chain link openings no larger than 1¾ inches, horizontal rails on the pool side when they're less than 45 inches apart, and gate latches mounted on the pool side at least 3 inches below the top when the release is under 54 inches high.

  5. 5. Call Tennessee 811 Before Anyone Digs

    Tennessee law requires notice to Tennessee 811 at least three working days before digging, and the ticket is good for 15 calendar days. Utilities mark their public lines, but Tennessee 811 notes they won't mark private ones, such as power to a detached garage, irrigation lines or the water line from the meter to the house. Tell us about anything like that before we set the first post.

  6. 6. Check the Contractor's Tennessee License

    Rutherford County is one of the Tennessee counties where a Home Improvement license is required for residential projects from $3,000 to $24,999, and the state lists fences among the improvements it covers. Projects of $25,000 or more require a state contractor's license before a contractor even bids. You can check any license at Verify.tn.gov, and Tennessee's Department of Commerce and Insurance notes that state home improvement law doesn't allow a contractor to ask for a down payment of more than one-third of the contract.

Do I need a permit for a fence in Murfreesboro?

Inside city limits, yes. The City requires a building permit for new fences and for moving or taking one down, but not for normal maintenance like replacing sections. In unincorporated Rutherford County there's no permit, but the County requires a notarized Fence Design Guideline Affidavit before you build.

How tall can my fence be?

In unincorporated Rutherford County, residential fences can be up to 8 feet in side and rear yards, and anything inside the required front setback has to be see-through. Inside the city, the fence permit page doesn't publish a height limit, so ask the Building and Codes Department about your zoning district when the permit is filed; your HOA covenants may be stricter than either one.

Can my fence go right on the property line?

The City doesn't require a setback for fences, and the County allows fences on or inside your property line, but neither lets a fence cross onto a neighbor's land or into an easement or the right-of-way. If you're not sure where the line is, a survey is cheap insurance against tearing out a fence later.

Which side of the fence faces my neighbor?

The finished side faces out. Rutherford County's ordinance requires posts, rails and cross members to face away from the street, and most HOAs ask for the same toward neighbors. A shadowbox or board-on-board design looks finished on both sides if that matters to you.

What's the best fence for a dog?
